This Privacy Notice explains how ACD Connect, ACD Direct, and eCallogy (collectively, the “Company,” “we,” “us,” or “our”) collect, use, store, share, and protect personal information about job applicants and candidates.
This notice applies to personal information we collect through our Applicant Tracking System (ATS), career site, email, video interview platforms, and other internal systems used in our recruiting and hiring process.
1. Information We Collect
We may collect the following categories of personal information:
- Contact and identifying information: Name, email address, phone number, mailing address, LinkedIn or other professional profile links.
- Professional and employment information: Résumé/CV, work history, education, skills, certifications, licenses, references, cover letter, salary expectations, and answers to application or screening questions.
- Interview and assessment data: Notes from interviews, responses to interview questions, video and/or audio recordings of interviews (when recorded), skills assessments, work samples, automated screening results from application or candidate filter questions, and other evaluation materials. We may use technology-assisted tools within our ATS to help filter or organize candidates based on responses to application questions. These tools assist the recruiting process and do not independently make hiring decisions. Candidate evaluations and final hiring decisions are made by authorized Company personnel.
- Background and employment eligibility information: Information obtained through background checks, where applicable and with required disclosures and authorization, and employment eligibility verification information, including Form I-9 information collected after an offer of employment and acceptance of employment.
- Technical and usage data: IP address, browser type, device information, and activity logs when you interact with our career site or ATS.
We collect this information directly from you, from public professional sources, from references you provide, and from third-party service providers that support our recruiting and hiring activities, such as background check vendors, assessment platforms, and recruiting technology providers.
2. How We Use Your Information
We use the personal information we collect for the following purposes:
- To process and evaluate your application.
- To assess your qualifications, skills, experience, and ability to perform the requirements of the position.
- To communicate with you about your application and the hiring process.
- To conduct interviews, including recorded video interviews when applicable.
- To perform reference and background checks, where permitted and applicable.
- To make hiring decisions and, if you are hired, to prepare for onboarding.
- To use technology-assisted recruiting tools to support application screening and organization of candidate information.
- To improve our recruiting processes, systems, technology, and candidate experience.
- To comply with legal obligations and protect our legal rights.
Technology-assisted tools used during the recruiting process do not independently make final hiring decisions. Final hiring decisions are made by authorized Company personnel.
3. Video Interviews
When we record a video interview, including video and audio, we do so for hiring evaluation purposes related to the applicable role. Access is limited to members of the hiring team and authorized personnel.
Candidates will be notified before recording begins and asked to provide any consent required under applicable law.
By participating in a recorded video interview after receiving the applicable notice and consent request, the candidate provides consent to the recording to the extent permitted by applicable law.
Recordings are retained only as long as needed for the hiring process and applicable legal or compliance requirements and are then securely deleted in accordance with Company retention practices.
Candidates may request an alternative interview format where required as a reasonable accommodation or where an alternative
process is otherwise made available by the Company.
4. How We Share Your Information
We share candidate information only as needed and with appropriate safeguards:
- With internal hiring managers, recruiters, and other employees involved in the hiring decision.
- With service providers that support our recruiting and hiring activities, including ATS providers, video interview platforms, background check vendors, assessment tools, and other recruiting technology providers, subject to appropriate contractual obligations and safeguards.
- When required by law, legal process, or to protect our rights, safety, or property. We do not sell candidate personal information.
5. Retention
We retain candidate personal information only as long as necessary for the purposes described above, including to meet applicable legal, regulatory, and internal compliance requirements.
Typical retention periods:
- Application materials and interview records: For candidates who are not hired, application materials, interview records, and related recruiting information are generally retained for six months following the hiring decision, unless a longer period is required by applicable law or otherwise necessary for legal or compliance purposes.
- Information related to hired candidates: Applicable recruiting records may be transferred to the employee's personnel records and retained in accordance with the Company's employee records retention practices and applicable legal requirements, including applicable payroll and wage-and-hour recordkeeping requirements. When information is no longer required to be retained, it will be securely deleted or otherwise disposed of in accordance with applicable law and Company retention practices.
6. Security
We use reasonable administrative, technical, and physical safeguards designed to protect candidate personal information against unauthorized access, use, or disclosure.
7. New York Applicants
If you apply for a position that is authorized to be performed in New York State, your personal information will be collected, used, stored, and disclosed as described in this Privacy Notice and in accordance with applicable federal and New York State law. As part of the recruiting process, New York applicants may be required to complete a recorded video prescreen interview. Before recording begins, candidates will be provided notice that the interview will be recorded and will be asked to provide any consent required under applicable law. By participating in a recorded video prescreen interview after receiving the applicable notice and consent request, the candidate consents to the recording to the extent permitted by applicable law.
Recorded video prescreen interviews are used as part of the Company's recruiting and candidate evaluation process. Recordings may be reviewed by authorized Company personnel and will be retained only for as long as reasonably necessary for recruiting, hiring, legal, compliance, or other legitimate business purposes, subject to applicable retention requirements.
The Company may also use technology-assisted tools within its ATS to help filter or organize candidates based on responses to application or candidate screening questions. These tools assist the recruiting process and do not independently make final hiring decisions. Candidate evaluations and final hiring decisions are made by authorized Company personnel. Candidates may request an alternative interview format where required as a reasonable accommodation or where an alternative process is otherwise made available by the Company.
New York applicants may contact the Company using the contact information provided in this Privacy Notice with questions regarding the collection, use, or handling of their personal information.
- New York City Work Location Clarification
ACD Connect, ACD Direct, and eCallogy are remote employers; however, the Company does not maintain a worksite in New York City and does not authorize the positions covered by this Privacy Notice to be performed from New York City. Positions are limited to the work locations identified in the applicable job posting and Company work-location requirements. A candidate's ability to apply for a position does not, by itself, establish New York City as an authorized work location. Accordingly, New York City-specific employment requirements apply only to the extent required by applicable law based on the position, authorized work location, and other applicable circumstances. This notice is not intended to waive or limit any rights that may apply to a candidate under applicable federal, state, or local law.
8. Your Choices and Rights
You may:
- Choose not to provide certain information, though this may affect our ability to process your application.
- Request information about how your personal information is collected and used.
- Request correction of inaccurate personal information.
- Request deletion of your application materials, subject to applicable legal, regulatory, security, or legitimate business requirements that require us to retain certain information.
- Request an alternative interview format where required as a reasonable accommodation or where an alternative process is otherwise made available by the Company.
